Viewzar respects the work of creators, Brands and every other rights owner. This Copyright and Takedown Policy explains what we expect from people who post on the Viewzar Content Feed, how rights owners can ask us to remove content that infringes their copyright, and what happens after they do.
This policy forms part of our Terms and Conditions and should be read together with our Community Guidelines. Viewzar is operated by HorizonRift Media Private Limited ("we", "us" or "our").
1. What this policy covers
1.1. This policy applies to everything posted on the Content Feed, including videos ("Clips"), covers, captions, comments, profile photos and bios, and to any other content on Viewzar that a rights owner believes infringes their copyright.
1.2. We follow the Copyright Act, 1957, the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (the "IT Rules"). Nothing in this policy limits any right or remedy a rights owner or a poster has under those laws.
2. Your promise when you post
2.1. Before you post a Clip, you must tick the box that says: "I own this video or have permission to post it."
2.2. By ticking it, you confirm that:
- you made the Clip yourself, or the owner of the Clip has given you permission to post it on Viewzar,
- you have the right to use everything in it, including footage, music, sound recordings, images, artwork, fonts, logos and trademarks,
- every person who can be identified in the Clip has agreed to appear in it, and anyone under eighteen (18) appears with the consent of their parent or lawful guardian, and
- posting it on Viewzar does not break any agreement you have with anyone else.
2.3. Credit is not permission. Tagging the original creator, writing "no copyright intended" or "all rights to the owner", or changing a video slightly does not give you the right to post someone else's work.
2.4. Music. Viewzar does not provide a music library. Any music or other audio in your Clip must be your own or used under a licence that allows it to be posted on Viewzar.
2.5. If your promise turns out to be untrue, we may remove the Clip and give your account a copyright strike, and you are responsible for any claim made against us because of it, as set out in our Terms and Conditions.
3. Clips posted by Viewzar and by Brands
3.1. Our own team seeds the Content Feed only with Clips that we own or that we have written permission from the rights owner to post.
3.2. Brands that post Clips confirm, like every other poster, that they own them or have permission to post them, including permission from every creator, model and other person who appears in them.
3.3. Clips posted by Viewzar or by a Brand are covered by this policy in the same way as any other Clip.
4. If your work has been posted without permission
4.1. If you own the copyright in a work, or are authorised to act for the owner, and you believe a Clip or other content on Viewzar infringes it, you can ask us to remove it.
4.2. Use our complaint form. The quickest way is our copyright complaint form. If you cannot use the form, you can write to our Grievance Officer with the same information, as described on our Grievance Officer page.
4.3. The report button. You can also report a Clip with the reason "copyright, or this is my video". A report alerts our team, but a formal complaint through the form gives us the details we need to act on it quickly and keeps a record of your request.
4.4. Other rights. For a trademark, privacy, publicity or other complaint that is not about copyright, write to our Grievance Officer.
5. What a valid complaint needs
A complaint must include:
- your full name and email address,
- the name of your organisation, if you are complaining for a company or on behalf of the rights owner,
- the link to the Clip or other content on Viewzar that you want removed,
- a link to the original work, or if it is not online, a description of it detailed enough for us to identify it,
- a description of how the content infringes your copyright, and
- a statement, made by ticking the sworn statement box on the form, that you believe in good faith that the use is not authorised by the owner or by law, that the information in your complaint is accurate, and that you are the owner of the copyright or are authorised to act for the owner.
We may ask you for more information, including proof that you own the work or are authorised to act for its owner. We may not be able to act on a complaint that is incomplete.
6. What happens after you complain
6.1. Acknowledgement. We send an acknowledgement to the email address in your complaint as soon as we receive it, and in any case within twenty-four (24) hours, as the IT Rules require. The acknowledgement carries a reference number.
6.2. Review. Our team reviews every complaint. While a complaint is open, we may hide the Clip from the Feed.
6.3. Decision. We resolve complaints within fifteen (15) days of receipt, or within any shorter period that Applicable Law prescribes. If a complaint concerns a Clip that shows you in nudity or a sexual act, or impersonates you, including with morphed or AI-generated images, we remove or disable access to it within twenty-four (24) hours, as Rule 3(2)(b) of the IT Rules requires. See our Grievance Officer page.
6.4. If we uphold the complaint, we remove the Clip or disable access to it, give the poster a copyright strike, and tell you that it has been removed.
6.5. If we do not uphold the complaint, we tell you why. If you have more information, you can reply with it and we will look again.
6.6. The poster is told. When we remove a Clip, we tell the person who posted it that it was removed and why. To allow them to respond, we may share with them the name of the person or organisation that complained and the details of the complaint, but not your email address or other contact details unless you agree.
6.7. The takedown log. We keep a log of every takedown: the content removed, the complaint, the decision, who made it and when. As the IT Rules require, a removed Clip and its records are kept out of view for one hundred and eighty (180) days, or for longer where a court or government agency requires it, so that they are available for any investigation.
7. If you think your Clip was removed by mistake
7.1. If your Clip was removed after a copyright complaint and you believe that you own it, have permission to post it, or that the law allows your use of it, you can ask us to look again by writing to our Grievance Officer, as described on our Grievance Officer page, within thirty (30) days of the removal.
7.2. Your request should include:
- your name, username and email address,
- the link to the removed Clip and the reference number in our notice, if you have one,
- why you believe the removal was a mistake, for example a licence, written permission or the fact that the work is your own, with any evidence you have, and
- a statement that the information in your request is accurate.
7.3. We review your request and may share it with the person who complained, so that they can respond. If we are satisfied that the removal was a mistake, we restore the Clip and withdraw the copyright strike, unless the person who complained tells us that they have started court proceedings about it or a court or authority has ordered the content to stay down.
7.4. Our decision on your request is final as far as Viewzar is concerned. It does not affect any right you or the person who complained may have to go to court.
8. Repeat infringers
8.1. Each upheld copyright complaint gives the poster's account a copyright strike. Copyright strikes are counted separately from the guideline strikes described in our Community Guidelines.
8.2. Three upheld copyright complaints and the account is removed. We may also remove an account sooner where the infringement is serious or deliberate.
8.3. An account removed for repeat infringement must not be replaced with a new account.
9. Open complaints and campaign earnings
9.1. A Clip with an open copyright complaint does not earn any campaign money, and no payout is made for it, while the complaint is open.
9.2. If the complaint is upheld, the Clip does not earn, and any earnings connected with it that have not yet been paid are cancelled, as our Terms and Conditions allow.
10. False or abusive complaints
10.1. Complaints must be made in good faith. Do not send a complaint about content you do not own, about content you have licensed, or to silence criticism or a competitor.
10.2. If we find that someone has knowingly sent a false or misleading complaint, we may reject it, refuse further complaints from them, and take action against any Viewzar account they hold. A person who sends a false complaint may also be responsible under Applicable Law for any harm it causes.
11. Changes to this policy
We may update this policy from time to time. The date at the top of this page shows when it was last updated.
